Terms of Use


Welcome to AstroChat, your personal Atro consultation platform. This Agreement sets out the legally binding terms for your use of the Site, usage and membership. This Agreement may be modified by Us from time to time. The access, membership and rights of admissions are reserved.

This Terms of Use is published in accordance with the Rule 3 (1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021.

General Description

The Site/App (“We/Site/Us ”) offers astrological content, reports, data, and consultations through video chat, Call and email (hereinafter referred to as “Content”) via the Site and Mobile applications, and other electronic mediums. We provide both “Free Services” and “Paid Services” (collectively referred to as “Services”). To access the Site/App and avail the Services, you are required to register as a member on the Site/App.

By registering on the Site/App you agree to:

  1. Provide current, complete, and accurate information as prompted by the Site/App. Creating a user profile with AstroChat involves providing specific information, including your phone number/email for OTP (One-Time Password) verification, which is required to ensure the security and validity of the registration process. Additionally, you may provide your first name, last name, date and time of birth (DOB), birth place etc. Please note that providing your date of birth is optional during the registration process, but may be needed while communicating with Astrologers to compile and calculate horoscope information.
  2. Maintain and update the provided information as required, ensuring that it remains current and accurate.
USER CONSENT

By registering, accessing and using the Site/App, you (“Member,” “You,” “Your”) confirm that you understand and unconditionally consent to the Terms of Usage. If you do not agree to the Terms, please do not click the “I AGREE” button. It is advised that you carefully read the Terms of Usage before starting using, registering on, or accessing any content, information, or services on the Site/App.

Additionally, by using this Site/App, you give your consent to receive communications from us via SMS/WhatsApp/Email/Call. Your continued use of the Site/App, including any updates or modifications to the Terms of Usage, signifies your acceptance and agreement to be legally bound by these terms till your account is deleted from Site/App. If you have any objection in collecting/processing your personal data, we advise you not to register with our Site.

If you want to withdraw this consent or if you have any objection in continuous collection or storage of your personal details, you must discontinue using our Service and delete your account by sending an email from your registered email ID to [email protected] as we shall not be able to provide you any Service without having your personally identifiable information listed above.

Registration and Eligibility

By using this Site/App, you confirm that you are over the age of 18 and legally capable of entering into a binding contract under the Indian Contract Act, 1872. We shall not be held responsible for any misuse of the services by minors by misrepresenting the age or any person using the Site/App inappropriately. However, you are allowed to ask questions related to minors in your family as per the terms outlined in this policy.

By using this Site/App, you represent and warrant that you have the right, consent, authority, and legal capacity to enter into this Agreement; submit relevant information to us; and that you are not prohibited or prevented by any applicable law for the time being in force or any order or decree or injunction from any court, tribunal or any such competent authority restraining you from entering into this Agreement and the Services thereof.

To access the services, you must register as a Member on the Site/App. By doing so, you agree to provide current, accurate, and complete information when filling out the sign-up form. All information you provide and update during your registration is referred to as "Registration Data."

You may create an account using your phone number (for OTP verification) or a valid email ID . By creating an account, you represent and warrant that all provided information is accurate and up to date, and you agree to keep it updated. Using another user’s account information/personal details is strictly prohibited. If any of the provided information is found to be inaccurate, incomplete, or outdated, the Site/App reserves the right to suspend or terminate the account and restrict or refuse access to future services. If you are creating an account on behalf of another, you hereby acknowledge that you have the required permission/authorization from the said person in writing and shall submit the same to Us, on receipt of the request from us in this connection.

The right to use this Site/App is personal to you and cannot be transferred to any other individual or entity. You are responsible for maintaining the confidentiality of your account information, including your password. You are fully accountable for any activities under your account. The Site/App will not be liable for any loss or damage arising from your failure to maintain the secrecy of your login credentials. You must notify the Site/App immediately if you become aware of any unauthorized access/use of your account.

When availing of any service, you will be informed if the service is provided directly by the Site/App or a third party. The Site/App does not control or monitor the information provided by third parties.

You acknowledge and agree that your personal data, including debit/credit card details, transmitted over the internet may be susceptible to misuse, hacking, theft, or fraud. The Site/App or its Payment Service Providers cannot be held responsible for such incidents.

The Site/App prohibits the use of its services under the following conditions:

  1. If you are a resident of a jurisdiction where the use of these services is prohibited.
  2. If you are a resident of a State/Country where laws or regulations prevent trade relations or services.
  3. Due to religious practices.
  4. You may not have more than one active account on the Site/App. Creating multiple accounts using different mobile numbers is prohibited.
FEATURE “CALL WITH ASTROLOGER”

The Site/App offers a service that allows you to have a conversation with an astrologer via various modes of communication such as Chat, Voice, & Video calling. By agreeing to these Terms of Usage, you provide your unconditional consent to the Site/App to arrange for these communications on your registered mobile number, via any means (including but not limited to chat, SMS, WhatsApp, regular calling, VOIP calling or video calling) even if your number is enrolled in Do Not Disturb (DND) services.

First Free Chat/CallContent/Service:USER ACCOUNT ACCESS

The Site/App may access the User's account and associated information to ensure the provision of high-quality services and to effectively address customer needs. By using the Site/App, the You grants unconditional consent for Site/App, its employees, agents, and other authorized personnel to access their account for these purposes. This access includes, but is not limited to, any data explicitly shared with Site/App, as well as chat and voice communication history with the astrologers and/or our third party service providers.

In the event of complaints or suspected abuse, we will investigate on a case-by-case basis using the available records & history. The User is advised to review the Privacy Policy for details regarding the handling of such records.

BREACH AND TERMINATIONUSER OBLIGATION

All Users, including both Astrologers and Member Customers, are obligated to comply with Site/App's Privacy Policy, Terms and Conditions, and any additional guidelines set forth on Site/App. By accessing Site/App, the User certifies and confirm that they are acting as an individual and not as a corporation or any other legal entity. The rights to access and use the services offered by Site/App are strictly personal to the User and may not be transferred to any other party or used for any commercial activities. .

While using the Site/App or engaging in any form of communication the Site/App or with the associated third-party service providers, the User agrees not to:

  1. Communication Consent: The User consents to receive communications through Site/App, including but not limited to app notifications, email, SMS, phone calls, and other communication channels (such as WhatsApp Business Messages) related to their use of Site/App.
  2. Reporting Violations: The User agrees to promptly report any misuse or violations of this Agreement to Customer Care.
  3. Consequences of Misuse: Should an internal investigation reveal any misuse or violations, Site/App reserves the right to terminate the User's membership without refund.
  4. False Complaints: The User acknowledges that any false complaint made by a Member may result in the termination of their membership without refund.
  5. Withdrawal of Services: Site/App reserves the right to withdraw services from any User deemed unreasonable or abusive in their interactions with Service Providers, including astrologers.
Inappropriate Content

We do not allow accounts that contain or promote sexual content or profanity, including pornography or any material intended for sexual gratification. Accounts that violate this policy are subject to immediate deletion without any refunds applicable. Additionally, we work with local law enforcement to report any illegal activities or content that may arise from such accounts.

Sexual Content and Profanity

To maintain a safe and respectful environment, we have established clear standards prohibiting harmful or inappropriate content on our platform.

Hate Speech

We do not allow content or users that promote violence or incite hatred against individuals or groups based on characteristics such as race, ethnicity, religion, disability, age, nationality, sexual orientation, gender, gender identity, caste, immigration status, or any other attribute tied to systemic discrimination or marginalization.

Terrorist Content

We do not allow any content related to terrorist organizations or activities.

Our platform is committed to maintaining a safe environment, and any content supporting terrorism will be immediately removed.

Dangerous Organizations and Movements

We do not permit content from organizations or movements that have engaged in, prepared for, or claimed responsibility for acts of violence against civilians. This includes any form of promotion, recruitment, or endorsement. We don’t allow users with content related to planning, preparing, or glorifying violence against civilians.

Sensitive Events

We do not permit content that capitalizes on or is insensitive toward sensitive events with significant social, cultural, or political impact, such as civil emergencies, natural disasters, public health emergencies, conflicts, deaths, or other tragic events.

Bullying and Harassment

We do not permit content that contains or facilitates threats, harassment, or bullying. Our platform is committed to providing a safe space where all users can interact without fear of being targeted or abused.

Dangerous Products

We do not permit the sale or facilitation of the sale of dangerous products, including explosives, firearms, ammunition, or certain firearms accessories. Our platform is committed to maintaining a safe and secure environment for all users.

We don't allow users that provide instructions for the manufacture of explosives, firearms, ammunition, restricted firearm accessories, or other weapons. This includes instructions on how to convert a firearm to automatic, or simulated automatic, firing capabilitie

Psychotropic drugs.

We don't allow users that facilitate the sale of marijuana or marijuana products, regardless of legality. We don't allow users that facilitate the sale of tobacco (including e-cigarettes and vape pens) or encourage the illegal or inappropriate use of alcohol or tobacco. We don't allow users that facilitate the sale of psychotropic drugs or drugs falling under the restricted category of Drugs and Cosmetics Act and Rules 1945.

Black Magic, Witchcraft, Voodoo and Tantrism

As an organization, we strictly prohibit users from engaging in or promoting any form of black magic, witchcraft, voodoo, tantrism, or any related occult practices. This includes any activities, content, or behaviours that encourage or involve these practices, whether intentionally or unintentionally. If it comes to our attention that a user is involved in such activities, we reserve the right to immediately suspend or delete the user's account without prior notice.

DELIVERY, CANCELLATION AND REFUND
  1. Refunds on Wallet Recharges
    • Once a member adds funds to their wallet on Site/App, those funds can only be refunded only if it fulfils both the conditions:
      • if the refund request reaches us within 48 hours of the wallet credit and
      • no portion of the credited amount has been used
    • In all other cases, i.e. if any portion of the credit has been utilized or if the request has been raised post 48 hours, the money will not be refunded.
    • Refunds, if applicable, will be processed only to the source payment instrument and after deducting all transaction charges imposed by the Bank, Payment Gateway, or any other charges incurred by the Site/App during the service delivery.
    • In case of server-related issues (e.g., slowdowns, failure, or session timeouts) on the Site/App or Payment Gateway, the User must:
      1. Check if the Bank Account has been debited before initiating a second payment.
      2. If the Bank Account is debited, avoid making the payment again and contact customer care to confirm the payment status.
      3. If the Bank Account is not debited, the User may initiate a fresh payment.
    • Refunds for multiple payments made for the same order, after the above precautions, will be processed in full, without transaction charges.
  2. Refunds of Service Charges
    • Refunds, if applicable, will be credited to the User’s wallet only. There will be no refunds done to the User’s bank account or original payment source if the refunds are processed under this section.
    • Refunds will only be considered under the following circumstances:
      1. Network issues affecting the chat/call, such as weak signal, background noise, or inaudible consultant.
      2. The consultant is unable to communicate fluently in the language specified in their profile.
      3. The consultant takes an excessively long time to respond.
      4. The consultant provides irrelevant or inappropriate responses to the user’s query.
    • No refund will be provided if the User has provided an incorrect contact number for the "Call with Astrologer" feature. The User is advised to ensure their contact number is within full coverage and must answer the call when received. No refund will be processed for calls that are successfully connected whether or not the User receives the call.
    • Refunds will not be provided for inaccuracies in the consultation. We do not guarantee the factual accuracy of consultations and take no responsibility for the accuracy of any advice given by the Astrologers/third party service providers.
    • By requesting a refund, the User agrees to grant our quality audit team access to the chat/call recording for the consultation. This is to determine whether the case qualifies for a refund.
    • People Interactive’s quality audit team will, in exceptional cases, provide partial or full refunds to the User’s People Interactive wallet if the consultant’s quality parameters are not met. Refunds may take up to 72 hours for analysis and processing.
DISCLAIMER/LIMITATION OF LIABILITY/WARRANTY

The User understands and agrees that, to the maximum extent permitted by law, We do not provide any warranties for its services. Astrological counselling provided through the Site/App is based on the individual or collective knowledge and interpretations of astrologers, and the results may vary from one astrologer to another.

INDEMNIFICATION

The User agrees to indemnify, defend, and hold harmless the Site/App, its parent company, subsidiaries, affiliates, officers, directors, employees, suppliers, consultants, and agents from any and all third-party claims, liabilities, damages, or costs (including but not limited to attorney’s fees) arising from:

PROPRIETARY RIGHTS TO CONTENT

You acknowledge that the Content, including but not limited to text, software, music, sound, photographs, video, graphics, or other materials contained in sponsor advertisements or distributed via email, and commercially produced information presented to the Member by People Interactive (I) Pvt Ltd, its suppliers, and/or advertisers, is protected by copyrights, trademarks, service marks, patents, and/or other proprietary rights and laws.

The User is not permitted to copy, use, reproduce, distribute, perform, display, or create derivative works from the Content unless expressly authorized by People Interactive (I) Pvt Ltd, its suppliers, or advertisers.

Additionally, content such as images, text, designs, etc., on all portals of People Interactive (I) Pvt Ltd is sourced responsibly, with due consideration for copyright laws. People Interactive (I) Pvt Ltd assumes no liability for copyright infringement of content or data sourced from external portals.
